Article 1: The organiser

The company Bongiorno BV, whose registered office is located at Koning Boudewijnlaan 16 bus 3 in Genk (3600), registered in the Kruispuntbank van de Ondernemingen under number 0899.880.282 (hereinafter 'Organiser') is organising a game from DATUM to DATUM from 12:00 to 23:59 with an obligation to buy under the name "Scratch & Win Berghoff gadgets and foodbox" (hereinafter 'Action') in Belgium, which is accessible on the website https://bongiorno.eu/nl/actie (the Dutch-language website) or https://bongiorno.eu/fr/action (the French-language website).

This Game is organised in the participating Prik&Tik drinking centres and it is promoted via promotional material in the participating drinking centres. Participation in the Campaign implies explicit acceptance of these Rules, without any reservation or prior condition. Infringement of these Rules by the participant automatically invalidates his/her participation and leads to the loss of any Prize, if applicable.

Article 2: Conditions for participants

The Action is exclusively reserved for physical persons of full age (according to the civil status) domiciled in Belgium (hereinafter the "Participant" or collectively the "Participants"), with the exception of the personnel of the Organiser, their relatives in direct line and, in general, anyone who has directly or indirectly contributed to the development, elaboration and/or administration of the Action.

Article 3: Duration

The Promotion runs and is valid from 20 May 2021 until 23:59hrs on 31 July 2021. The Promoter reserves the right at any time and without prior notice to extend, suspend or terminate the Promotion if circumstances so require. The Promoter may not be held liable in such cases. These changes or modifications will be communicated in advance via the appropriate channels as far as possible.

Article 4: Method and conditions of participation

In order to validly play and participate, the Participant must

• purchase a Bongiorno food product at a Prik&Tik shop within the predefined duration of the Campaign and while stocks last. There are 21600 scratch cards available, distributed in 90 boxes across the Prik&Tik shops. 1 Bongiorno food product entitles the participant to 1 scratch card. The participant receives the scratch card at the till.
• Correctly answer the question asked by the person in charge at the cash register
• Scratch off the provided scratch area on the scratch card after correctly answering the competition question and immediately check whether or not they have won or lost a Prize.
• If the provided scratch pad indicates that he has won a Prize, then the Participant (hereinafter "the Winner") should:
  • in the event that he/she has won a Berghoff Gadget, as defined in article 5 below, to produce his/her proof of purchase and the playing card and the aforementioned Prize will be handed over to him/her at the box office.
  • in case an additional unique code appears in the scratch field, go to the website https://bongiorno.eu/nl/actie (the dutch website) or https://bongiorno.eu/fr/action (the french website), give his/her unique code, his/her contact details and a correct answer to the competition question.

A maximum of one winner per family (with the same name, living at the same address) will be accepted for the duration of the Promotion. Any costs incurred to participate in the Promotion will not be refunded.

Article 5: Prices

The prizes to be won are: - The prizes to be won mentioned in article 4 are:

• 1x Berghoff Cheese grater (1 per box, so 90 in total)
• 2x a Berghoff Vegetable peeler (2 per box, so 180 in total)
• 3x a Berghoff Kitchen Knife (3 per box, so 270 in total)
• 5x Berghoff juicer (5 per box, so 450 in total)
• A Bongiorno Foodbox (1 foodbox per month, so 3 in total)

For the Berghoff Gadgets (Prizes 1, 2, 3 and 4), the Winners must go to the Prik&Tik cash desk at the place of purchase and show their proof of purchase and the winning scratch card to obtain the Prize. In addition, they must correctly answer the competition question posed by the cashier.

For the Bongiorno Foodbox, the Winners will then be notified by Bongiorno BV by email and invited to collect the Foodbox free of charge from the Prik&Tik shop where the Winner received the scratch card at a specified time or to receive the Foodbox free of charge at their home at a pre-specified time.

The Winner(s) engage(s) to provide accurate and up-to-date information. Each Winner is responsible for the information they communicate at all times. The Promoter shall not, under any circumstances, be held liable if it is unable to reach a Winner to notify them that they have won or if the Prize is lost due to an incorrect or outdated address. The Prizes on offer may not, under any circumstances, be contested as to their nature or value. It is not possible under any circumstances to request the equivalent of a Prize in cash or in any other form. If circumstances require, the Organiser reserves the right to substitute a Prize with any other Prize of similar value. In such event, the Winners will not be entitled to any consideration other than the new Prize. No equivalent value of the Prizes in the Promotion will be offered as compensation. The Promoter will not provide any service or guarantee other than the provision of the Prizes as set out in the Rules and disclaims any liability for any incident, accident and/or damage that may occur whilst using the Prizes. The Promoter's liability cannot be invoked due to the quality of the Prize in relation to that announced or expected by the Participant, the terms of delivery or any damage of any kind (physical injury, moral, material, etc.) that may be suffered or caused by the Winner or any other person. Any claim by the Participant or any third party may only be made against the manufacturer of the product which comprises the Prize.

Article 6: Breaches of these Regulations

The Organiser undertakes to do its best to respect the equal treatment of the Participants. Any infringement or attempted fraud contrary to these Rules will invalidate the fraudster's participation and result in the loss of any Prize won. The Organiser may therefore suspend or cancel the participation of one or more Participants if suspicious or fraudulent behaviour is detected in order to unlawfully acquire one or more Prizes. The Organiser shall have sole discretion to decide on the exclusion or re-admission of the Participants concerned based on the information available.

In the event of complaints, Participants will be required to provide proof that they have acted in accordance with these Regulations. The Organiser may not be held liable in this regard. The Organiser may stop all or part of the Campaign if it appears that fraud has been committed in any form, including computer fraud. The Organiser reserves the right to pursue those who have violated these Regulations by any means necessary and in particular by legal process.

Article 7: Liability

7.1) The Prizes: The Promoter assumes no responsibility for the condition of the Prizes. In the event of a defect in the Prize, Winners are invited to make their claims directly to the manufacturer of their Prize.

7.2) 7.2 Game changes: The Promoter may not be held liable if, for reasons beyond its control, this Promotion is wholly or partially modified, shortened, postponed or terminated, even without prior notice, if circumstances so require. To the extent possible, such modifications or changes shall be announced in advance through the appropriate channels.

Article 8: Personal data

The Participants shall allow any useful verification of their identity and place of residence. 4 Any false declarations, false identities or false addresses shall result in the immediate elimination of the participant concerned and, where applicable, in the refund of the Prize already withdrawn.

Winners accept that their name, photos or any record of the Campaign or its results may be used by the Promoter for publicity or editorial purposes without any compensation being claimed. Personal data necessary for the implementation of the Campaign will be processed. In order to participate in the Campaign, you must provide the following information (hereinafter "the Data"):

• The unique code on your scratch card
• Your Prick&Tick store
• Your first name
• Your last name
• Your address (street + number)
• Your city
• Your postal code
• Your e-mail address
• Contest question

The Data of the Participants is collected for the purpose of participating in the action described in these Rules and will be kept for this purpose for the duration of the Action, increased by 4 months to cover the period for receiving the Prize. Nevertheless, prior to their deletion, the Data may be kept in intermediate archives during the legal limitation period in order to preserve evidence of your participation, the sending of Prizes or your consent to the defence of the rights of the Promoter. This Data may be processed on paper or by automated processing. This information is intended for the Organizer acting as the data controller, its group companies and its subcontractors, including the Organizer. In accordance with applicable law and the European Data Protection Regulation in force since 25 May 2018, Participants have a right of access, rectification, withdrawal, partial or total deletion of the personal data concerning them, which they may exercise by making a written request to : Bongiorno BV - Koning Boudewijnlaan 16 bus 3 - 3600 GENK or at the following e-mail address: vincenzo@bongiorno.eu. They also have the right to the transferability of the Data. In addition, the Participants also have the possibility of establishing specific or general guidelines, which may be modified or deleted at any time, regarding certain processing operations, for the storage, erasure and communication of their personal data in the event of their death. The specific guidelines may be registered with the controller. General Guidelines can be registered with a reliable digital third party certified by the competent authority. Finally, the Participants have the right to lodge a complaint with the competent authority, namely: - Data Protection Authority (DPA) with regard to Participants residing in Belgium

Article 9: Inspection of the Rules

It is stated that these regulations can be consulted freely at the cash desk of your participating drinking centre and on the website https://bongiorno.eu/nl/actie (the Dutch-language website) or https://bongiorno.eu/fr/action (the French-language website).

Article 10: Disputes

Any difficulties in the interpretation or application of these Regulations will be settled by the Organiser in accordance with Belgian law. Any conduct by a Participant that may harm the Organiser's image and/or is contrary to public order and/or morality may result in invalidity of that Participant's participation in the Action. The Organiser may, automatically and without prior notice, exclude any Participant who has not complied with these Regulations and proceed to the pure and simple cancellation of any Prize to which that Participant may be entitled. If one of the clauses of the present rules becomes invalid due to a change in legislation, deregulation or judicial decision, this will in no way affect the validity and observance of the other clauses of the rules. 6 These Rules are governed by Belgian law. No requests (written, oral or otherwise) will be answered concerning the interpretation or application of these Rules, the conditions and/or the mechanism of the Action and the determination of the Winners. In the event of a dispute or complaint, for any reason, the request must be sent to the Organiser at the address stated in Article 1 within a maximum period of 7 days following the closure of the competition (postmark as proof), failing which the right may be withdrawn. Any disputes that may arise in connection with these Regulations and that cannot be settled amicably will fall within the jurisdiction of the Antwerp Commercial Court.
